Defamation, Slander, and Libel

Defamation is a tortious act encompassing both slander and libel, involving the making of false statements about an individual or entity that harm their reputation, and that are communicated to third parties. To establish a claim of defamation, one must typically demonstrate the following elements: (1) the defendant made a false statement of fact; (2) the statement was published to a third party; (3) the statement caused harm to the plaintiff's reputation; and (4) the defendant acted negligently or with actual malice, depending on the applicable legal standard.
